The $3 Million Dollar Court Case

In the early 1990’s, there was a court case with more bearing and significance on the nutritional industry than almost any other.  The case involved a company selling isolated chemical nutrients that objected and discounted the fact that FoodMatrix™ nutrients were better absorbed, retained, and utilized.

Five independent and internationally recognized FDA scientists were assigned to examine the molecular structure of the FoodMatrix™ supplements. These scientists were required to analyze the results and submit their findings to a California District Judge. To determine the nutritional differences, leading edge technologies from NASA were used, including nuclear magnetic resonance equipment.

The Judge Makes a Decision.

On February 8, 1993, this $3 million lawsuit came to an end when the California district Judge made his ruling based on all evidence presented to him during the case (Case # C8920658SW). The Judge ruled that the following claims are allowed to be made:

• FoodMatrix™ nutrients are better than isolated USP nutrients.
• FoodMatrix™ nutrients may be better absorbed, retained and utilized than USP nutrients.
• FoodMatrix™ nutrients are manufactured under an exclusive proprietary process.
